Terms of Use

1. Agreement to these Terms
These Terms of Use ("Terms") are a legal agreement between you and Everyday Insight LLC ("Everyday Insight," "we," "us," or "our") governing your use of the Everyday Insight mobile application and any related content, features, and services (collectively, the "App").
By downloading, accessing, or using the App, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, do not use the App.
Your use of the App is also subject to Apple's Licensed Application End User License Agreement ("Apple Standard EULA"). If these Terms conflict with the Apple Standard EULA, the Apple Standard EULA governs to the extent of the conflict for distribution through the App Store.
2. Not medical advice
Everyday Insight is a self-help and educational wellness tool. It provides cognitive behavioral therapy (CBT), dialectical behavior therapy (DBT), acceptance and commitment therapy (ACT), and positive-psychology worksheets, mood and habit tracking, guided exercises, psychoeducation, and standardized self-assessment questionnaires.
- The App does not provide medical or mental-health advice, diagnosis, or treatment.
- The App is not a substitute for professional care from a licensed physician, therapist, counselor, or other qualified health provider.
- Using the App does not create a doctor-patient, therapist-client, or any other professional or fiduciary relationship between you and Everyday Insight.
- The self-assessment tools in the App (including PHQ-9, GAD-7, K-10, PCL-5, and AUDIT) are screening and self-monitoring aids only. They are not diagnostic instruments and do not, by themselves, establish the presence, absence, or severity of any condition. Only a qualified professional can diagnose a health condition.
- Always seek the advice of a qualified professional with any questions about a medical or mental-health condition. Never disregard professional advice, or delay seeking it, because of something you read or did in the App. Talk to a professional before making decisions about your care, including starting, stopping, or changing any treatment or medication.
3. Emergencies and crisis situations
The App is not an emergency service and cannot provide help in a crisis. It does not monitor your entries, cannot detect an emergency, and will not contact anyone on your behalf.
If you are experiencing a medical or mental-health emergency, are thinking about harming yourself or others, or are otherwise in crisis:
- Call your local emergency number (911 in the United States) or go to the nearest emergency room.
- In the United States, call or text 988 (the Suicide & Crisis Lifeline), or text HOME to 741741 (the Crisis Text Line).
- Contact a trusted person, your doctor, or a local crisis service.
The crisis resources and phone numbers shown in the App are provided for convenience only. We do not operate, endorse, or guarantee the availability, accuracy, or quality of any third-party helpline, and numbers or services may change.
4. Eligibility and age
You must be at least 13 years old to use the App. If you are between 13 and 18 years old (18 being the age of majority in California), you may use the App only with the knowledge and consent of a parent or legal guardian who agrees to these Terms on your behalf and supervises your use. The App is not intended for children under 13, and we do not knowingly permit their use of the App or collect their information. 5. Your responsibilities
You agree to:
- Use the App only for your own personal, non-commercial wellness purposes.
- Provide accurate information where you choose to enter it, understanding that the usefulness of the App depends on what you put in.
- Use your own clinical and personal judgment, and consult a professional where appropriate, rather than relying on the App as a source of medical or mental-health decisions.
- Comply with all applicable laws in your use of the App.
You are solely responsible for any decisions or actions you take based on your use of the App.
6. Your content and your data
The worksheets, journal entries, assessment responses, and other information you enter are your content. Because Everyday Insight is designed to be local-first, your content is stored on your device (and, if you enable iCloud sync, in your personal iCloud account). We do not operate servers that store your content, and we cannot access, retrieve, restore, or delete your content for you. See the Privacy Policy for details on storage, encryption, and your choices.
You are responsible for maintaining your own backups. If you delete the App, reset or lose your device, or disable iCloud sync, your content may be permanently lost, and we will have no way to recover it.
7. License to use the App
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use one copy of the App on Apple devices that you own or control, as permitted by the Apple Standard EULA and the App Store Usage Rules, solely for your personal, non-commercial use.
8. Restrictions
You agree not to, and not to permit anyone else to:
- copy, modify, distribute, sell, lease, sublicense, or create derivative works from the App;
- reverse engineer, decompile, or disassemble the App, except to the extent that applicable law expressly permits despite this limitation;
- remove or alter any proprietary notices;
- use the App in any unlawful manner or for any unlawful purpose;
- use the App to provide services to third parties (for example, as a clinician delivering care), except as expressly described in the App's therapist-sharing features and then only as a supplement to, not a replacement for, your own professional judgment; or
- attempt to interfere with the App's security or intended operation.
9. Intellectual property
The App, including its software, design, text, graphics, worksheets, guided exercises, and other content we provide (excluding your content and excluding the standardized public-domain or third-party assessment instruments, which remain the property of their respective owners), is owned by Everyday Insight LLC or its licensors and is protected by intellectual-property laws. Except for the license in Section 7, these Terms grant you no rights in the App or our content.
10. Third-party services
The App may interact with third-party services, including Apple (App Store, iCloud, HealthKit, and on-device speech recognition) and Open-Meteo (optional weather data used for mood correlation). Your use of those services is governed by their own terms and privacy practices. We are not responsible for third-party services and do not endorse or guarantee them.
11. Disclaimer of warranties
The App is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.
Without limiting the foregoing, we do not warrant that the App will be uninterrupted, error-free, or secure; that any content, technique, or assessment in the App is accurate, complete, current, or suitable for your situation; or that use of the App will improve any health or wellness outcome. Any reliance you place on the App is at your own risk.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, Everyday Insight LLC and its owners, employees, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, loss of goodwill, or personal or emotional injury, arising out of or relating to your use of, or inability to use, the App, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the App or these Terms will not exceed the total amount you have paid us for the App, which is US $0.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, fraud, or willful misconduct. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Everyday Insight LLC and its owners, employees, and licensors from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the App or your violation of these Terms or applicable law, except to the extent caused by our own misconduct.
14. Changes to the App and to these Terms
We may update, change, or discontinue the App or any feature at any time. We may also update these Terms from time to time; when we do, we will change the "Last updated" date and post the revised Terms in the App and at geteverydayinsight.com/app/terms. Your continued use of the App after the revised Terms take effect means you accept them.
15. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, except where applicable consumer-protection law of your home jurisdiction provides otherwise.
Before filing any claim, you agree to first try to resolve the dispute informally by contacting us at [email protected] and giving us at least 30 days to resolve it. If we cannot resolve the dispute informally, you and we agree that any dispute arising out of or relating to the App or these Terms will be brought exclusively in the state or federal courts located in California, and you and we consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking relief in a small-claims court for qualifying claims, or from seeking injunctive relief to protect intellectual-property rights.
16. Miscellaneous
If any provision of these Terms is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and the Apple Standard EULA, are the entire agreement between you and us regarding the App.
